Terms of service
Plain words on purpose. If a sentence here and a signed agreement disagree the signed agreement wins.
3Fold LLC is a Puerto Rico limited liability company. We build private dashboards and small pieces of software for businesses. These terms cover everything we sell on 3fold.me.
When you pay for a diagnostic or a call or a build through 3fold.me you agree to these terms. If you do not agree do not pay.
A Workflow Leak Diagnostic for one business workflow. Custom software for one business workflow at a time. A build is optional and comes after the diagnostic. A board is one thing we may build. What we build works with the tools you already use. A person on your team approves every message before it goes anywhere.
After the build we may offer monthly work. That work is quoted in writing and priced on its own. Nothing recurring starts without your yes.
The diagnostic is $250. You pay once.
It reviews one business workflow that you choose. We look at how it runs today and where time or money is lost. You get a written report with findings and an action plan.
A model drafts the report from your answers. Kent reviews it before we release it.
We aim to deliver within three business days after your details are in. That is a target and not a promise.
The diagnostic is not refundable. It does not count toward other work.
Implementation is optional. You can use the report without us.
A Deep Dive Call is $250 for 15 minutes with Kent. You pay before you book.
The payment is final. You can move the time from the booking email.
We record the call. By booking you agree to the recording. The recording and a written note of it stay on your record.
A build starts at $5,000. A standard build is $5,000: $2,500 when you approve the written scope and $2,500 when we tell you in writing that the build is ready for acceptance. Larger builds are priced in the written scope.
The written scope is one week of work. Our target. We look at how your work runs today and write down what the board will check and where each check reads its information and what it costs to run each month.
You keep the written scope whether or not you go ahead with the build. Once the plan is delivered the fee for it is earned and is not refunded.
The build is two to three weeks of work. Our target. We build what the written scope says. We build it in your accounts with read only access to the tools the scope names.
The software shows information and drafts messages. A person on your team approves every message before it goes out. Nothing sends itself unless you ask for that in writing and we agree to it in writing.
Our targets are targets. They depend on access to your tools and on answers from your team.
Work outside the written scope is extra work. We write it down and price it before we start. You say yes in writing. Then we build it.
A change that moves the timeline is written down the same way.
We ask only for the access the written scope needs. Read only wherever the tool allows it. You can take that access away at any time.
We never keep your passwords in plain text. Where a tool gives us a key or a token we store it encrypted.
You are responsible for having the right to give us that access. If a tool belongs to a client of yours or a partner of yours you get their permission first.
When the final payment clears you own the custom code we wrote for you and the documentation that goes with it.
We keep the right to reuse general patterns and components and know how that are not specific to your business.
Your data is always yours. We never claim it.
We do not promise results. Not revenue. Not customers. Not savings. The software shows you information and drafts messages. The decisions are yours.
The outside tools the board reads can change or fail or go quiet. When a feed goes quiet the board says so. We are not responsible for what an outside tool does.
Payments go through Stripe in US dollars. The diagnostic fee and the call fee are due when you buy. The first build payment is due when you approve the written scope. The second is due when we tell you in writing that the build is ready for acceptance.
If a build payment is late the work pauses until it arrives. Prices on the site can change. The price you paid is the price you paid.
What we learn about your business while doing this work stays between us. We use it only to do the work.
The same goes the other way. How we build and price is ours and stays with you.
Either of us may share information when the law requires it.
If something goes wrong our total responsibility to you is limited to the fees you paid us in the twelve months before the claim.
We are not responsible for indirect losses. That includes lost profit and lost data you did not back up and the cost of a decision made from what the board showed.
Nothing here limits any responsibility that the law does not allow us to limit.
Either of us can stop the work by written notice. Email counts.
Work already paid for stays paid for. We hand over what exists at that point. You keep the written scope if it was delivered.
These terms are governed by the laws of the Commonwealth of Puerto Rico.
Any dispute is handled in the courts of San Juan in Puerto Rico. Both of us agree to that.
We may change these terms. The new version is posted here with a new date. The version in force when you paid is the one that applies to that purchase.
